Section 6.10 of the CC&R's: Parking of vehicles by Owner shall be restricted to the Owner's garage or driveway. Parking in the street by Owner is prohibited, except for any parking areas so designated by the Board of Directors.
The section is about prohibited street parking and exceptions to these prohibitions. The entire section is about street parking. The only parking areas in our community are the streets. The board can designate any area of the streets for parking. They have already done this with rules around guest parking.
Section 6.30 of the CC&R's: Association Rules and Regulations. In addition, the Association from time to time may adopt, modify or revoke such nondiscriminatory rules and regulations governing the conduct of persons and the operation and use of the Property (including, without limitation, use of playground and parking areas as it may deem necessary or appropriate in order to assure the peaceful and orderly use and enjoyment of the Property. The Association Board of Directors thereof, shall deliver a copy of the Rules and Regulations, upon adoption, and a copy of each amendment, modification or revocation promptly to each Owner. The Board of Directors of the Association may adopt the rules and regulations, except as may be otherwise provided in the Bylaws of the Association.
Additionally, the board has added the following to the “General Community Policy Guidelines”: Street parking is for short-guests only. Short-term guest is interpreted to mean “an Owner’s primary residence is not inclusive of the neighborhood of Westview Villas”. The parking allowance for short-term guest parking is seven (7) days within any given calendar month. (Class C Infraction)
To paraphrase, the board may adopt rules governing the use of the property to assure the peaceful and orderly use and enjoyment of the property, including parking. The board used this authority to create rules around guest street parking - designating street parking for guests only. They can also make rules around owner street parking.
Crystal Lake Community Management believes "parking area" does not include the streets.
But, the document makes no distinction between "street parking" and "parking area". The intent was to give the board the flexibility to manage street parking in the community, as they have already done with limited guest parking.
